The website www.corseperformance.com.au (the “Site” or “Website”) is a motorcycle accessories shopping website where you can browse, select, and order products advertised by Corse Performance.
You agree to receive communications from us and from our third-party service providers and you agree to accept "cookies" and other similar devices used by this Website to perform our services. You also agree that we may call or email you about any incomplete or unconfirmed enquiry you make through our Website. Further information on the use of data can be found in our Privacy Policy.
YOUR LEGAL RIGHTS
Your purchase of goods will be subject to certain laws including, without limitation, the Australian Consumer Law. The Australian Consumer Law provides you with certain rights that cannot be excluded, including that the goods must be of acceptable quality, reasonably fit for the purpose that Corse Performance represents they will be fit for, and that the goods will correspond with any relevant description. Nothing in these Terms and Conditions shall be read or applied to exclude, restrict, or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot by law be excluded, restricted or modified.
DISCLAIMER
Corse Performance has taken every care to ensure that the information posted on the Site is correct and up to date at the time of publishing on the Internet. We shall not be responsible for any detriment incurred by reliance you place on this Site or its contents. However, Corse Performance will endeavour to correct any inaccuracies once Corse Performance becomes aware of them.
Illustrations and photos contained on the Site are sample representations of the products advertised, and variations may occur from time to time.
CHANGES
Corse Performance has the right to change or discontinue any features of this Site including materials, hours of availability and may also impose limits on certain features and services or restrict your access to parts of or the entire Site without notice or liability.
As we always seek to provide our customers with the most competitive prices, we reserve the right to change prices displayed for products on the Site at any time.
CANCELLATION OF ORDERS
Corse Performance reserves the right to cancel, at any time before delivery and for whatever reason, an order that it has previously accepted. Corse Performance may do this for example, but without limitation, where:
(a) Corse Performance suppliers are unable to supply goods that they have previously promised to supply;
(b) an event beyond Corse Performance control such as storm, fire, flood, earthquake, terrorism, power failure, war, strike or failure of computer systems, means that Corse Performance is unable to supply the goods within a reasonable time;
(c) Goods ordered were subject to an error on the website, for example, in relation to a description, price or image, which was not discovered prior to the order being accepted;
(d) You ask Corse Performance to cancel your order. Corse Performance will use reasonable endeavours to cancel or change the order if it has not already been shipped but makes no representation that it will be able to do this.
PRODUCT PRICES
Prices displayed on the Site represent the full price in Australian dollars (AUD), for the product itself and includes delivery anywhere in Australia. It does not include international postage/delivery charges and shipping charges which will depend on the destination.
INTELLECTUAL PROPERTY
This Site contains copyright material, registered and non-registered trademarks that are protected by law and are the property of Corse Performance and various third parties (“intellectual property rights”). You must not use our material and any of the marks or trademarks appearing on the Site or our name without our prior written consent.
ONLINE PURCHASING ACCOUNT
You agree to provide a true, complete and accurate email address, delivery address(es), billing address(es) and telephone number and to keep these details up to date. Incorrect information provided could lead to a delay in delivering your product(s) or non-delivery of your products.
By placing an order with Corse Performance you give Corse Performance permission to subscribe you to marketing emails. You can opt-out/unsubscribe from these emails at any time. To unsubscribe, click the unsubscribe link found at the bottom of all emails sent by Corse Performance and follow the steps.
LIMITATION OF LIABILITY
Corse Performance shall not be liable for any lost profits, lost savings, injury, public liability, loss of reputation, loss of goodwill, any kind of commercial or economic loss, indirect, incidental, punitive, special, or consequential damages arising out of or in connection with the agreement of the sale of any products or services by Corse Performance or the use thereof whether or not such damages are based on tort, warranty, contract or any other legal theory – even if Corse Performance has been advised, or is aware, of the possibility of such damages.
Corse Performance’s aggregate and cumulative liability towards Buyer under any agreement shall not exceed an amount of ten percent (10%) of the related agreement.
Any Buyer’s claim for damages must be brought by Buyer within ninety (90) days of the date of the event giving rise to any such claim and any lawsuit relative to any such claim must be filed within one (1) year of the date of the claim. Any claims that have been brought or filed not in accordance with the preceding sentence are null and void.
The limitations and exclusions set forth above in this Limitation and Liability Section shall apply only to the extent permitted by applicable mandatory law.
TRADE IN PROGRAM
All tyre warmer sets regardless of condition or brand are worth a $100 credit towards a new set (only one trade-in set for each new set). A warmer must be largely complete to be eligible (eg two half warmers only qualify as one warmer). If only one tyre warmer is provided, it will be worth a $50 credit towards a new set (only one trade-in set for each new set) or new individual warmer (only one trade-in warmer for each new warmer).
The warmers are used like cash, the racer pays a portion of the new set with the old set to be traded in and we need to receive them in order to apply the credit.
The credit cannot be applied with any other discount when purchasing the warmers.
To claim the credit, the Buyer must:
1. Contact Corse Performance to advise of the trade-in. The Buyer must provide the following details for an eligible trade in:
a. Full name,
b. Account email address,
c. Billing address,
d. Telephone number,
e. Quantity and brand of warmers being returned.
2. Corse Performance will issue a Trade In code and delivery address. The Buyer is to retain this code and is to ensure the warmers being shipped are appropriately identified with this number.
3. The Buyer is responsible for arranging shipping at their expense to the Corse Performance delivery address.
4. Corse Performance will then issue a Promo Code to the Buyer to use when purchasing a warmer and the credit will be applied to the purchase price.
RETURNS
Corse Performance promises to deliver high-quality products in good condition. If, for any reason, your purchase is not satisfactory, we will gladly replace it or refund your money (excluding delivery charges where applicable). Simply return your merchandise with the original paperwork and packaging within 30 days of receiving your order. We promise to process your request in a timely manner.
We can only accept returns for items that are unused, undamaged, and in original packaging with all accessories. You have 30 days from the date of delivery to return items for an exchange, refund, or store credit.
If the item supplied us is a warranty or faulty, we’ll happily pay for return shipping and provide a full refund or exchange. Change of mind purchases or size exchanges require the customer to pay for any return postage costs.
Where a warranty fault has been recognized and accepted by us, shipping expenses will be refunded. For any replacements where the shipping expense is being covered by Corse Performance, the original shipping address will be used.
Exchanges will only be provided on products that are clean, unused and in a saleable condition. This means that the product must be in its original packaging, including manuals and all accessories, and the product(s) is unopened, unused and in its original condition. All electrical components cannot be returned if packaging seal is broken.
To return an item, simply:
1. Contact Corse Performance to advise of the return. The Buyer must provide the following details to make an eligible return:
a. Full name,
b. Account email address,
c. Billing address,
d. Telephone number,
e. Quantity and brand of warmers being returned.
f. Proof of purchase.
2. Make sure the item is unused, undamaged, and in the original packaging with all accessories included.
3. Do not attach the return shipping label to the product packaging. Doing so will void your return.
4. Securely place the items into your Corse Performance delivery packaging (or a similar sized box if you no longer have it). Please ensure that your item is packed safely and securely to prevent damage in transit.
5. Following the instructions emailed to you, print your return shipping label, and securely tape it to the packaging your item was delivered in. Take care not to cover the barcode.
6. Drop the parcel off at your local Australia Post outlet
SHIPPING POLICY
Unless otherwise specified, we ship via Australia Post.
WARRANTY INFORMATION
All Corse Performance warmers come with a three-year warranty from date of purchase.
Corse Performance will, at their option, repair or replace defective warmers free of charge during the warranty period, including standard shipping to Australian Buyers. This includes ANY flaw during the manufacturing process including normal heat-up, temperature accuracy or failure.
The warranty only excludes misuse or abuse to the product, such as:
1. Leaving the warmer plugged in or energised while NOT mounted on a tire
2. Bunching or folding the warmer over during operation
3. Using on the incorrect tyre size, over-lapping the warmer
4. Stepping on, riding over or crushing the warmer
5. Riding away with the warmers still mounted
6. Using the warmers on physically wet tyres or subject to rain or other moisture during their operation
PRIVACY POLICY
Corse Performance is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.
This Personal Information is obtained in many ways including correspondence, by telephone, by email, via our website www.corseperformance.com.au, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.
We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.
When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information. Corse Performance does not usually request or collect Sensitive Information
Sensitive information will be used by us only:
• For the primary purpose for which it was obtained
• For a secondary purpose that is directly related to the primary purpose
• With your consent; or where required or authorised by law.
Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
Disclosure of Personal Information
Your Personal Information may be disclosed in several circumstances including the following:
• Third parties where you consent to the use or disclosure; and

Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
Corse Performance will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.
In order to protect your Personal Information we may require identification from you before releasing the requested information.

It is an important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.
